2. Response to DMCA Notices

Upon receiving a valid DMCA Takedown Notice, Insta-Up will:

  • Investigate the claim and, if warranted, remove or disable access to the infringing content.
  • Notify the user responsible for the allegedly infringing content that their material has been removed or disabled.
  • Provide the user with the option to file a Counter-Notice if they believe their content was wrongfully removed, as outlined below.

3. Filing a Counter-Notice

If you believe that the material removed due to a DMCA Takedown Notice is not infringing, or that you have the legal right to post the content (for example, through fair use or permission from the copyright owner), you may submit a Counter-Notice to Insta-Up.

To file a Counter-Notice, you must provide the following information in writing:

  • Your Contact Information:
    Include your full name, address, phone number, and email address.
  • Identification of the Removed Content:
    Provide the URL(s) or location(s) where the content was previously available before it was removed.
  • Statement of Good Faith:
    A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Consent to Jurisdiction:
    Include a statement that you consent to the jurisdiction of the federal court in your district or the district where you are located, and that you will accept service of process from the person who submitted the original DMCA notice.

4. Repeat Infringers

Insta-Up takes copyright infringement seriously. In accordance with the DMCA and other applicable laws, we have adopted a policy that provides for the termination of users who are repeat infringers. If a user is found to repeatedly infringe on the intellectual property rights of others, we may, at our discretion, terminate their account and access to our services.
